I discussed with the prosecutor a pretrial diversion, but because of my client’s previous DUI conviction he was ineligible for a pretrial diversion. Because he was not eligible for the pretrial diversion, I negotiated for a first offender plea under 16-13-2. He had been charged with an expired registration violation, for which he failed to appear in court. On Monday, November 13, at 1:00 PM, I appeared with my client in Milton City Court to defend him against a DUI charge. My client was involved in an accident which was not his fault. His car was T-bones by a speeding driver, and although my client was not at fault he was arrested for DUI. Getting under 21 y/o client’s speeding ticket dismissed. On Thursday, February 1, 2018, I appeared in Atlanta City Court to defend my client against a speeding ticket. My 19 years old client and his mother accompanied me to court. Following negotiations with the prosecutor I was able to get his been reduced to 14 mph over the limit. This is a win for my client because this information will not go to the Georgia Department of driver’s records and his insurance company will not be notified.
