Defending clients Following too close Today, Tuesday, January 30, 2018, I had three different potential clients call me, all charged with following too close accidents. A following too close accident is a very common occurrence in metropolitan Atlanta. The metro areas roads are filled to capacity. In an effort to add even more cars on a street, the distance between cars has reduced to unsafe. The Georgia law states that a driver must maintain sufficient distance between his car and the car in front to stop safely without a collision. This is true even in a chain reaction collision where multiple vehicles are involved. You should follow the car in front of you slowly and allow enough space to stop safely. Frequently, when you provide enough space, another car will pull into that safe space that you provided. Defending client in Gwinnett County against methamphetamine charge. On Wednesday, October 25, 2017, I appeared in Gwinnett Superior Court with my client. He had been charge with the sale of methamphetamine. This appearance was for a hearing on the consideration of bond. After negotiation with the prosecutor, I got the court to agree to allow my client to be released on a $10,000 bond. This bond was posted within 72 hours and my client was released. Getting under age driver's super speeder ticket reduced in Cobb County On Thursday, October 26, 2017, I appeared with my client in Cobb County State Court. My client, who is under 21 years of age, was ticketed for doing 72 mph in a 45 mph zone. If convicted my client would’ve had his drivers license suspended. However, following negotiations with the prosecutor I was able to get his speed reduced to 14 mph over the limit. This issue will be treated as a simple speeding ticket. My client will have to pay a fine of $173, however there will be no suspension of his license, no points added to his driving record, and his insurance company will not be informed about this incident. Fighting client speeding ticket in Fulton Country Court. On Monday October 23, 2017, I appeared for my client in Fulton County Court. My client who lives in South Carolina was not able to return to Atlanta to attend court. He had been charged with a following too close accident. After negotiation with the prosecutor, I got the court to agree to dismiss my client’s charge following the prosecutor performing his due diligence to make sure that the damage had been repaired to the other drivers vehicle. Getting client's speeding ticket dismissed in Ball Ground Georgia. On October 20, 2017, I appeared with my client in the Ball Ground, GA. Municipal Court. My client had been charged with speeding 25 mph over the limit. After consultation with prosecutor, I was able to get my client’s speed reduced to 14 mph over the limit. My client will have to pay a fine of $250. There will be no points added to his Georgia driving record and there will be no record of this ticket sent to his insurance company. Defending client against aggravated stalking in Gwinnett Co. On October 12, 2017, I appeared with my client in Gwinnett Superior Court for a bond hearing. My client had been charged with violation of a restraining order, “aggravated stalking.” Following negotiations with the court and based on the circumstances involved in this case, I got the district attorney to agree to a reasonable bond. The bond was posted within 24 hours. This result allowed my client to leave jail and continue to work, while I plan and negotiate for his defense. Fighting DUI for under 21 year old client in Fulton Co. Court I appeared with my client in Fulton County Court to defend him against a DUI, driving less safe charge. This particular case is made more difficult, because my client is under 21 years of age. Following discussions with the court, I move for the court to dismiss the charges against my client based on the failure of the prosecution to provide the video of the arrest. I knew for full well that this was the first jury trial calendar, and the judge would probably deny the dismissal, which he did. The judge reset the case for another jury trial in March. This gives me a additional time to work on my client’s defense, however if the prosecution fails to provide the video a second time, then I can get my client’s charge dismissed. Getting client’s speeding ticket reduced in Sandy Springs, GA. On October 11, 2017, I appeared on behalf of my client in the Sandy Springs City Court. He is a resident of South Carolina and could not arrange to return to Sandy Springs to attend court. My client was ticketed for driving 90 mph in a 55 mph construction zone. Even though this was my clients third speeding ticket in two years, I was able to get the court to reduce his speed to 14 mph over the limit. This issue then becomes a simple speeding ticket. There will be no reporting of his ticket to the Georgia Department of driver services. Also, his insurance company will not be notified of this issue, and his insurance rates will not increase. Because of my client’s past history of multiple speeding tickets, he will have to pay a court fine of $735, and upon the payment of the fine, his case will be closed. This is a wonderful outcome for a person with a history of multiple past speeding tickets. He was not found guilty of a super speeder violation in a construction zone. If he had been found guilty his insurance rates alone would have increased far beyond the $735 fine.On October 11, 2017, I appeared on behalf of my client in the Sandy Springs City Court. Fighting client's super speeder in Peachtree City, GA. On October 11, 2017, I appeared with my client in the Peachtree City Municipal Court. My client who is under 21 years of age was charged with a super speeder ticket. While waiting to speak with the prosecutor, I was informed that the prosecutor was sick and the case was to be continued in December. Unfortunately, we were not able to resolve this case today, which is understandable because of the prosecutors illness.
