Fighting client's theft by taking charge in Fulton County In November, I appeared in Fulton County Court with my client who was accused of fraud and theft by taking. Following negotiation with the prosecutor, I convinced to court to prevent my client from having to serve time in jail. The court allowed my client to pay back the restitution amount claimed by the prosecution. My client was unable to pay this in full at one time, so I negotiated for a payback over a period of time. When the restitution amount is paid in full the case will be dismissed. In November, I appeared in Fulton County Court with my client who was accused of fraud and theft by taking.

Getting client’s speeding and reckless charge cleared in Alpharetta. On Tuesday, January 16, 2018, I appeared with my client in the Alpharetta Municipal Court My client had been arrested for driving 101 mph in a 65 mph zone. He was also charged with reckless driving and underage possession of alcohol. I had previously negotiated with the prosecutor and the court for a hold and clear. A hold and clear can be thought of as an earned dismissal. My client had completed 100 hours of community service and a defensive driving course. He made 3 payments to the court, one for each offense, $625, $625, $525. On Wednesday December 13, 2017, I appeared with my client in the Peachtree City Municipal Court. My client had been charged with driving with a suspended license. My client was previously charged with a super speeder ticket and he paid the ticket on line. My client was unaware that when he paid the ticket, because he was under age, it would result in a suspension of his license. Following negotiations with the prosecutor, I convinced the court that if my client knew that his license would have been suspended, he would not have paid the fine which was a guilty plea. I convinced the prosecutor to resend the guilty plea because of the payment of the fine. This then nullified the driving with a suspended license charge. On Wednesday, December 6, 2017, I met with my client in Alpharetta Municipal court. He had been issued three traffic citations. One for speeding 107 mph in a 65 mph zone, one for reckless driving, and one for violation of an instructional driving permit for a 17 year old. Following negotiations with the prosecutor, I was able to negotiate for a hold and clear which is an earned dismissal for my client. I was also able obtain a restriction of his arrest record. This earn dismissal will take place after my client completes a defensive driving class, donates 25 hours of community service, pays a fine, and temporarily submits his drivers license to the court until completion of the requirements. He will then get his license back rather than have his drivers license suspended by Georgia DDS. This is a big win for my 17-year-old client and his family. www.lawofficeofscottmiller.comOn Wednesday, December 6, 2017, I met with my client in Alpharetta Municipal court. On Wednesday December 6, 2017, I appeared with my client in the Milledgeville, GA. Municipal Court. She had been charged with marijuana possession. On my way into the court, I noticed a sign in the court lobby promoting the local food bank. I sensed that it would be reasonable and the spirit of the holidays, to ask the court if my client could donate her fine to the food bank, in exchange for a dismissal. After I suggested this to the prosecutor, the court agreed and my client received a dismissal.
