On Wednesday December 13, 2017, I appeared with my client in the Peachtree City Municipal Court. My client had been charged with driving with a suspended license. My client was previously charged with a super speeder ticket and he paid the ticket on line. My client was unaware that when he paid the ticket, because he was under age, it would result in a suspension of his license. Following negotiations with the prosecutor, I convinced the court that if my client knew that his license would have been suspended, he would not have paid the fine which was a guilty plea. I convinced the prosecutor to resend the guilty plea because of the payment of the fine. This then nullified the driving with a suspended license charge. On Wednesday, December 6, 2017, I met with my client in Alpharetta Municipal court. He had been issued three traffic citations. One for speeding 107 mph in a 65 mph zone, one for reckless driving, and one for violation of an instructional driving permit for a 17 year old. Following negotiations with the prosecutor, I was able to negotiate for a hold and clear which is an earned dismissal for my client. I was also able obtain a restriction of his arrest record. This earn dismissal will take place after my client completes a defensive driving class, donates 25 hours of community service, pays a fine, and temporarily submits his drivers license to the court until completion of the requirements. He will then get his license back rather than have his drivers license suspended by Georgia DDS. This is a big win for my 17-year-old client and his family. www.lawofficeofscottmiller.comOn Wednesday, December 6, 2017, I met with my client in Alpharetta Municipal court. Getting client’s stop sign violation in Alpharetta dismissed. On Tuesday, December 5, 2017, I appeared with my client in the Alpharetta Municipal Court. Defending my client against hit and run in Alpharetta, GA. On Wednesday, November 15, 2017, I appeared in Alpharetta Municipal Court with my client. She had been charged with hit and run. The other driver was subpoenaed and was present in court. The prosecutor insisted on a guilty plea or a no contest plea for my client. If my client had played guilty, it would have resulted in loss of her driver’s license. In an effort to get the best result possible for my client, I had the case transferred to Fulton County State Court. On Friday, February 2, 2018, I received 3 calls from prospective clients all charged with following too closely. Each one of these individuals explained their accident in roughly the same way. Each prospective client was traveling during rush hour or busy metro Atlanta streets, were there was almost no room between cars for errors. When the car in front comes to an abrupt stop the vehicle in the rear will more than likely collide with a vehicle in front. This happens so many times a day in metro Atlanta that it is almost routine. Atlanta is a dangerous city to drive in, and our insurance rates reflect that fact. So, what is the person to do? Most traffic experts will advise the following: (1) plan your trips when traffic is the lightest. Get up early and leave for work while traffic is light. If you must, spend an hour in a coffee shop near your office before your office opens. On your commute home consider having a snack or even dinner before you get on the road to your home. (2) take an alternative route even though it may be further to reach your destination. People tend to use the shortest route, and therefore the short route will be the busiest.
