Fighting client's speeding and reckless driving in Alpharetta: Wednesday, February 20, 2019: I accompanied my client to Alpharetta Municipal Court to fight his super speeder and reckless driving tickets. My client had been given a super speeder ticket for traveling 103 mph in a 65 mph zone, and he was arrested for reckless driving. This reckless driving charge was his second in two years. Georgia code 40 – 6–189 reads that anyone driving over 85 mph on any Georgia Road will be charged with a super speeder ticket and fined an additional $200 by the state, in addition to other fees and penalties. Failure to pay this fine within 90 days will result in suspension of driving privileges, and an additional $50 will be assessed. Reckless driving: Georgia code 40 –6–390 reads that a person who is convicted of driving any vehicle in a reckless disregard for the safety of persons and property shall be guilty of reckless driving. Reckless driving is a misdemeanor crime in the state of Georgia. After lengthy negotiation with the prosecutor, I was able to get the court to agree to reduce my client’s speed to 79 mph in a 65 mph zone. This is now 14 mph over the limit and becomes non-reportable to the Georgia Department of drivers records. I was also able to negotiate a hold and clear on the reckless driving charge. My client will have to complete 25 hours of community service, pay a fine of $1000 plus court costs, and complete a defensive driving class. Upon completion of all of the above, my client’s case will be closed and his arrest restricted.Wednesday, February 20, 2019: I accompanied my client to Alpharetta Municipal Court to fight his super speeder and reckless driving tickets.

Friday, March 8, 3:00 PM: I appeared in Roswell court with my client for her administrative license hearing. My client had been charged with DUI. Georgia code 40-6-391 is Georgia’s driving under the influence statue. In the State of Georgia,if someone is arrested for DUI,GA code 40-6-391, it is common for the arresting officer to take away, confiscate, the drivers license and replace it with an ALS form. This form is a DS – 12054 form. You are permitted to file for an ALS hearing within 10 days of your arrest. At the ALS hearing you can request that your license be returned so that you can use your vehicle to drive to work. I spoke with the arresting officer who was willing to withdraw the suspension until the upcoming court arraignment date. Now my client will have use of her license to drive her vehicle to work. I will prepare her defense for her upcoming DUI court arraignment.

Getting client’s super speeder reduced in Forsyth County, GA. Friday, March 8, 2019: I appeared with my client in Forsyth State Court. My client had been charged with a super speeder ticket for driving 89 mph in a 65 mph zone. Georgia code 40–6–181 requires that anyone driving 24 mph over the posted speed limit will have 4 points added to their Georgia Department of driver services record. Georgia code 40– 6–189 requires that any one speeding at 85 mph or higher on any road in Georgia is in violation of the super speeder law and will be fined accordingly to the Georgia super speeder law. This fine is in addition to the local city or county municipality fine. Following negotiation with the solicitor General of the Forsyth State Court, I got the court to agree to a reduce my client’s speed to 14 mph over the limit, which is non-reportable to the Georgia Department of driver services. This also eliminates the super speeder fee. My client was required to pay a fine of $143, and the case was closed. Defending 2nd. client in Forsyth State Court for super speeder. March 8, 2019, at 4:55 PM: I appeared with my 2nd. client and her father in Forsyth State Court. She had been charged with a super speeder ticket for traveling 89 mph in a 65 mph zone. Georgia code 40 – 6–181 states that anyone convicted of driving 24 mph over the speed limit will have 4 points added to their Georgia drivers record. Georgia code 40 – 6–189 requires anyone speeding 85 mph or higher or any Georgia Road will receive a super speeder ticket, and upon conviction of the super speeder ticket, the state of Georgia will impose an additional fine of $200. Following negotiation with the solicitor General, I got an agreement to reduce my client’s speed to 14 mph over the limit. This will be non re-portable to the Georgia Department of driver services, and this will not be a super speeder ticket. The client will have to pay a fine of $143, and no further action will be taken. Fighting client’s speeding and reckless driving in Atlanta. Friday, March 8, 2019: I appeared in Atlanta city court with my client who had been charge with speeding and reckless driving. Her case had been originally scheduled for arraignment on January 10, 2019. It was re-set for today. My client had been charged with speeding 104 mph in a 55 mph zone. This is 31 mph over the limit. She was arrested and taken to jail for reckless driving. Georgia code 40–6–181-Speeding: Anyone convicted of speeding 24 to 33 mph over the posted speed limit shall have 4 points added to their Georgia Department of driver services record. Georgia code 40–6–390–reckless driving: Any person who drives any vehicle with reckless disregard for safety of persons or property commits the offense of reckless driving. Reckless driving is a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed $1000 or imprisonment not to exceed 12 months or a booth. Following extensive negotiations with the prosecutor, I was able to get her reckless driving charge dismissed. I was also able to get the 31 mph over the speed limit reduced to 24 mph over the speed limit, and she pleaded Nolo to the speeding ticket.Friday, March 8, 2019, 10:39 AM: I appeared in Atlanta city court with my client who had been charged with speeding and reckless driving.

Fighting 17 year old’s speeding ticket Alpharetta Wednesday, March 6, 2019: I appeared with my 17 year old client and her parents in the Alpharetta Municipal court. My client had been charged with speeding, driving 87 mph in a 65 mph zone. This is 22 mph over the speed limit. Georgia code 40–6–181: Anyone convicted of speeding 19 to 23 mph over the posted speed limit will have three points added to there driving record. The fact that my client is only 17 years of age, makes this speeding ticket more difficult to negotiate. I advised my client prior to coming to court to complete the Georgia defensive driving class. Following negotiations with the prosecutor, I was able to get my client’s speed reduced to 79 mph in a 65 mph zone which is 14 mph over the limit and get her speeding ticket dismissed. She had already taken the defensive driving class and after paying the fine of $187.50 her case was closed without it being reporting to the Georgia Department of driver services. Fighting Florida client speeding ticket in Alpharetta Wednesday, March 6, 2019: I appeared for my client in the Alpharetta Municipal court. He is a Florida resident and was not able to return to Alpharetta to attend court. My client had provided me a copy of a Florida defensive driving course which had been completed. My client had been charged with driving 83 mph in a 65 mph zone. Which is 18 mph over the speed limit. Georgia code 40-6-181 states that anyone convicted of speeding 15 to 18 mph over the speed limit will have two points added to their driving record. After negotiation with the prosecutor I was able to get my client’s speed reduced to 14 mph over the limit. I paid my his fine of $187.50 out of my general funds, which I will be able to bill to the client, and his case is closed. Fighting client's speeding ticket in Milton, Georgia. March 4, 2019: I appeared with my client in the Milton municipal court. My client had been issued a speeding ticket for going 58 mph in a 40 mph zone. Following considerable negotiation with the prosecutor, I was able to get the court to agree to reduce my client’s speed to 14 mph over the limit, which is non-reportable, if my client pays a $193 fine, and takes a defensive driving class. We accepted this proposal, and my client’s case will be reset until May 3, 2019 for client’s completion of defensive driving class. Neither my client or I will need to return to court on that date, as client will submit the certificate of completion of driving class and pay this fine before May 3.March 4, 2019: I appeared with my client in the Milton municipal court. My client had been issued a speeding ticket for going 58 mph in a 40 mph zone.
