I recently represent a client who was driving from Florida to Nashville and was ticketed for speeding in a work zone Article 9, of Georgia code 40-6-188, Designates that when a section of highway or road is under construction or repair, there should be an erected sign indicating a highway work zone’s beginning and end. Also, there is to be a posted sign indicating the reduced speed limit in the highway work zone. He was ticketed on l-75 for speeding in a highway work zone. The speed limit in a work zone will be reduced at least 10 mph or more than the established speed on this road. Any person convicted of exceeding the speed limit posted in any highway work zone shall be guilty of a misdemeanor, and shall be punished by a fine of not less than $100 nor more than $2000, or by imprisonment of a term not to exceed 12 months. My client had been charged with traveling at 64 mph in a 45 mph zone. After negotiation with the prosecutor, I was able to get the speed reduced to 14 mph over the limit.
