Fighting client's serious injury by vehicle charge in Fulton. June 12, 2019, 10:00 AM: I appeared in Fulton Superior Court with my client, my client’s family, the victim, and victim’s family. My client had been charged with Georgia code 40-6-394. This code defines serious injury by vehicle, and if one is found guilty of, is a felony. This code does not require that malicious intent to harm be proven. The assistant district attorney from the bond hearing was present and spoke to the victim and her parents. My client is off to pretrial services following this morning’s appearance. Fighting client’s super speeder ticket in Forsyth State Court On Thursday, June 6, 2019, I appeared in Forsyth State Court accompanied by my client. He was ticketed for driving 90 mph in a 65 mph zone. If my client had plead guilty by paying the fine, he would also have to pay an additional $200 to the State of Georgia. Fortunately for my client, after negotiation with the prosecutor, I got the court to agree to reduce his speed to 79 mph in a 65 mph zone. This is 14 miles an hour over the speed limit and is non-reportable to the state of Georgia. My client will be required to complete one defensive driving class. Then he must then pay the fine and submit proof of completion of the defensive driving class. After this is completed, my client’s charge will be dropped. Following negotiation with the prosecutor, I got the court to agree to reduce my client’s speed to 59 mph in a 45 mph zone. 59 mph is 14 miles over the speed limit, and this will become a non-reportable offense to the Georgia Department of Drivers Services. Because my client was not present, I paid his court fine for him, so he will not have a speeding charge on his record. Getting client’s striking pedestrian charge amended. In December, I appeared with my client in Sandy Springs City Court. My client had been charged with striking a pedestrian. Georgia code 40-6-91, Failure to yield right of way in crosswalks, states that the driver of a vehicle shall stop and remain stopped to allow a pedestrian to cross the roadway within a crosswalk. Georgia code 40-6-93, Failure to exercise do care near a pedestrian, states that every driver of a vehicle shall exercise due care to avoid colliding with a pedestrian. Following negotiation with the prosecutor, I got to court to agree to amend my client’s charge to driving too fast for conditions. Driving too fast for conditions is a non re-portable charge. No record of this incident will be made with the Georgia Department of driver services. His insurance company will not find out about this incident. My client will continue to have a clean record. Getting client's stop sign violation dismissed in Alpharetta. In December, I appeared with my client in Alpharetta Municipal Court, he had been charged with failure to stop at a stop sign. Georgia code 40-6-72, failure to stop, states that a driver of the vehicle approaching a stop sign shall stop at a clearly marked stop line. If there is no stop line, the driver must stop before entering the crosswalk. In this particular case, my client had attempted to stop after crossing the marked stop line. After discussion with the prosecutor, I was able to convince the court to dismiss my client’s charge. Fighting client's following to close charge in Alparetta City Court: In December, I appeared in Alpharetta City Court to defend my client against the charge of following too closely. Georgia code 40-6-49 requires that any driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent having regard for the speed of such vehicle and the traffic on the highway and the condition of the highway. If convicted of following too closely, that person would be guilty of a criminal misdemeanor, and must pay a fine and court costs, and have three points added to the Georgia drivers record. December: In John’s Creek Court defending client's improper turn. In December, I appeared in Johns Creek City Court to defend my client who was charged with improper turn, driving in the median, and driving on the wrong side of the roadway. Georgia code 40-6-123 covers improper turn. It states that no person shall turn a vehicle into an intersection unless the vehicle is in the proper position upon roadway. Georgia code 40-6-126 provides that if a highway has a central lane in which traffic may enter from any direction, no vehicle shall be driven into such central lane except for the purpose of making a left turn. Georgia code 40 – 6–40 requires vehicles to drive on the right side of the roadway. Conviction of any of the above Georgia codes will add three points to their Georgia drivers record. In this particular case in Johns Creek City Court, I was able to convince the prosecutor to dismiss all of my client’s charges. Striking a pedestrian in the crosswalk Fighting client’s striking pedestrian charge in Sandy Springs Court In September, I appeared with my client in Sandy Springs Municipal Court. He had been charged with striking a pedestrian. Georgia code 40 – 6–91 describes the driver’s obligation to stop for a pedestrian in a crosswalk. Georgia code 40 – 6–93 covers failure to exercise due care near pedestrians. Georgia code 40 – 6–94 covers failure to yield to a blind pedestrian. In all three cases, the driver of a vehicle is obligated to stop for any pedestrian in a crosswalk. Anyone convicted of any of these three offenses shall be subject to a fine, and have three points added to their drivers license record. In this particular case, after lengthy negotiation with the prosecutor, I was able to get the prosecutor to agree to dismiss the charge. My client will be required to attend traffic school, a defensive driving class, and show the court that his insurance company has settled any claim by the pedestrian.
