Getting client’s shoplifting charge dismissed in Alpharetta: In December, I appeared in Alpharetta Municipal Court with my teenage client who had been charged with shoplifting at Northpoint Mall. The Georgia code 16-8-14 describes shoplifting as: when a person removes or attempts to remove merchandise from a retail establishment for his or her own use without paying for the same. If the retail value of the merchandise is less than $300, and this is the first offense, it will be prosecuted as a criminal misdemeanor. If the value of the retail merchandise is $300 and above, it will be prosecuted as a felony and shall be punishable by imprisonment for not less than 1 year and no more than 10 years. My teenage client was encouraged by her peers to attempt the shoplifting. Prior to this incident her record was clean and she’s had no criminal miss behavior. Following considerable negotiation between myself and the prosecutor and the merchant, I got the court to agree to dismiss her charge after she has made restitution, completed community service, written an essay “the harm of shoplifting”, and attended a anti-shoplifting school. My client and her family were ecstatic. On Friday, March 16, 2018, I appeared with my client in the Dunwoody Municipal Court. My client who is a young female had been arrested for shoplifting at Walmart. Following considerable negotiation with the prosecutor, I was able to get the court to agree to pretrial diversion. This will allow my client to earn a dismissal of the shoplifting charge and a restriction of her arrest record. My client will have to perform community service and attend shoplifting classes. She has concerns about the renewal of her immigration status. So, in an effort to expedite this process, I convinced the court to allow my client to appear on the first available date as a walk-in, so all of this could be completed before her immigration renewal. Fighting client's theft by taking charge in Fulton County In November, I appeared in Fulton County Court with my client who was accused of fraud and theft by taking. Following negotiation with the prosecutor, I convinced to court to prevent my client from having to serve time in jail. The court allowed my client to pay back the restitution amount claimed by the prosecution. My client was unable to pay this in full at one time, so I negotiated for a payback over a period of time. Fighting client’s shoplifting charge in Forsyth Magistrate Court On Thursday, October 26, I appeared with my client in Forsyth Magistrate Court to fight his second in a lifetime shoplifting charge. On my clients previous charge, we had negotiated a pretrial diversion which means that my client could obtain and earned dismissal following completion of several steps. Following negotiations with the court on the second in a lifetime charge, I was able to get my client enter a first offender plea. A first offender plea is often used for a felony charge, however in this particular case it seemed appropriate to use it for a misdemeanor shoplifting charge.On Thursday, October 26, I appeared with my client in Forsyth Magistrate Court to fight his second in a lifetime shoplifting charge.
