Any driver who's vehicle collides with another vehicle is, required to stop his vehicle and provide his identifying information and insurance information to the owner driver. If the vehicle struck is unoccupied the driver must leave his identifying information and contact number on the vehicle in a prominent location so that the owner of the unoccupied vehicle can easily see it. In this particular case my client did not think he was required to stop because, the school bus was on the other side of the road. However, the Georgia law requires that unless there is a median in the road, all traffic shall come to a stop when a school bus is stopped to loading or unload passengers. On March 4, 2015, I appeared in the Dunwoody Municipal Court to defend my client against the charges of, shoplifting and giving false evidence to a law-enforcement officer. This was her first in a lifetime arrest. Following negotiations with the prosecutor, I was able to work out a pretrial diversion and a record restriction, expungement for my client. This pretrial diversion is an earned dismissal. My client must perform 40 hours of community service, attend a shoplifting seminar, and also pay the court costs.
