The 40 Y/O was arrested for a DUI on April 21, at 1:45 in the morning. She was observed driving erratically in Roswell. When the arresting officer pulled her over, he found that her seven-year-old daughter was in the back seat. The child reportedly moving around in the back seat, unsecured, and there appeared to be no child safety restraint devices contained in the vehicle.
When stoped she refused a breathalyzer test, but was still arrested because she failed her field sobriety test.
In Georgia, if you refuse to take a breathalyzer test, the result is an immediate loss of license privileges. The defendent was endangering the life of her child and will likely be charged for both the DUI and child endangerment. She is not speaking to the press, according to her adult daughter, about the DUI case. She is denying that she was drunk at the time and says there is no proof because she refused the test.
Refusing the blood or breath test does not mean that there is no proof that she was drunk. The test is just evidence in a case, but there are a lot of other factors to consider in a DUI case, including the field sobriety test results and the police report.
